TERMS OF USE

Welcome to C1 Fitness App

Our C1 Fitness mobile application (“C1 Fitness” or the “C1 Fitness App”) has been developed and brought to you by United Minds Middle East L.L.C-FZ, as an exclusive product offered to members of the C1 Network (“You”) who choose to download our mobile application, C1 Fitness (“We”, “Our”, “Us”). By choosing to download the C1 Fitness App and use the provided services, You express your acceptance to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please refrain from downloading and using the App.

Capitalised terms that are not defined in this document shall have the same meaning given to them in C1’s policy documentation. The terms ‘App’ and ‘Platform’ may be used interchangeably when referencing the C1 Fitness App, and they adopt the same meaning.

AGREEMENT TO TERMS

These Terms are between You and United Minds Middle East L.L.C-FZ, not with any other third-party such as Apple Inc. (“Apple”) or Google LLC (“Google”). You hereby acknowledge that Apple and Google are not responsible for the C1 Fitness App, its content, or its functionality. Apple, Google and Huawei are third-party beneficiaries of these Terms and may enforce the Terms against you.

The C1 Fitness App is a fitness and wellness mobile application that provides you with workout programs, fitness tracking, progress monitoring, and additional features that may be added or removed from the platform from time to time at our discretion.

ELIGIBILITY

You must be at least 18 years old to download and use the App. You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality and security of your account credentials and for all activities under your account.

Please note that the App may not be available in all jurisdictions.

USER OBLIGATIONS AND PROHIBITED CONDUCT

You agree to use the App only for lawful purposes and in accordance with these Terms.

Prohibited Activities:

• Providing false or misleading health information;
• Sharing inappropriate, offensive, or harmful content;
• Attempting to hack, reverse engineer, or compromise the App's security;
• Using automated scripts or bots to access the Service;
• Violating any applicable laws or regulations;
• Harassing or threatening other users;
• Impersonating others or creating fake accounts;
• Violating the terms of our Intellectual Property;
• Rent, lease, sublicense, distribute, or otherwise transfer the App;

INTELLECTUAL PROPERTY RIGHTS

Our Proprietary Content

The App, including our original content, features, functionality, user interface, and proprietary algorithms, is owned by C1 Fitness and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable revocable license to use the App and access the workout content for your personal fitness and wellness purposes in accordance with these Terms and any applicable Apple Store, Google Play or Huawei AppGallery terms (as may be the case).

You may not copy, download, redistribute, or commercially exploit the workout videos or content contained within the App.

Third-Party Components

The App incorporates third-party software libraries, content, and services ("Third-Party Content") that are subject to their respective owners' intellectual property rights and licensing terms. Your use of the App constitutes acceptance of all applicable third-party licenses. We make no warranties regarding Third-Party Content and disclaim all liability for their performance, availability, or compliance with intellectual property laws.

Usage Restrictions

You may not:

• - Copy, modify, distribute, reverse engineer, or create derivative works based on the App or any Third-Party Components
• - Extract, separate, or attempt to access Third-Party Content independently
• - Use the App in any manner that violates third-party intellectual property rights
• - Remove or alter any proprietary notices, labels, or marks from the App or Third-Party Components

Indemnification

You agree to indemnify and hold C1 Fitness harmless from any claims, damages, or expenses arising from your misuse of Third-Party Content or violation of third-party intellectual property rights through your use of the App.

THIRD PARTY INTEGRATIONS

C1 Fitness App may integrate with third-party health and fitness services, including but not limited to Apple Health, Google Fit, Huawei Health, Fitbit, and other wearable device platforms (collectively, "Health Services"). Your use of these services is subject to the Health Service own terms and privacy policy, and C1 Fitness will not store any of your integrated data. Integration does not constitute our endorsement of third-party services.

By enabling these integrations, you:

• (a) authorize us to share your fitness data (including workout duration, calories burned, exercise type, and performance metrics) with your chosen Health Services in accordance with their respective privacy policies;
• (b) acknowledge that your use of integrated Health Services is governed by the Health Service own terms of service and privacy policies, which are separate from ours;
• (c) understand that we cannot guarantee the accuracy of data received from Health Services, and any health-related decisions should be made in consultation with qualified healthcare professionals;
• (d) may disable these integrations at any time through the App settings,
• (f) understand that Health Service integrations depend on third-party availability and functionality, which may change or become unavailable without notice.

We are not responsible for any issues, data loss, privacy breaches, or service interruptions related to third-party Health Services. You use these integrations at your own risk and discretion.

REWARDS SYSTEM

C1 Fitness App offers a gamification feature, enabling you to earn rewards when you complete a workout.

How Rewards Work

• You earn in-app rewards by completing workout videos in full;
• We track workout completion automatically when you finish a video;
• Rewards may include points, badges, achievements, or other incentives;
• Your reward history is stored in your account for tracking progress.

Rewards are exclusively an in-app feature only, to track progress, and they do not represent any monetary value outside the App.

REWARDS EARNED IN THE APP HAVE NO CASH VALUE, ARE NON-REDEEMABLE AND ARE NON-REFUNDABLE.

PRIVACY AND DATA PROTECTION

Your privacy is important to us. Please review our Privacy Notice, which is incorporated into these Terms by reference.

We comply with Apple’s App Store Review Guidelines, Google Play’s Developer Program Policies, and Huawei AppGallery’s Developer's Service Agreement including rules on user date, tracking transparency, and permissions.

SERVICE AVAILABILITY AND MODIFICATIONS

We strive to maintain service availability but do not guarantee uninterrupted access to the C1 Fitness App. We reserve the right to modify, suspend, or discontinue any features or functionality of the App at any time with reasonable notice, including any Third-Party Content. Additionally, we may require you to install updates to continue using our App; failure to do so might limit or discontinue your access to C1 Fitness.

TERMINATION

You may terminate Your account at any time through the App settings or by contacting customer support. We may also suspend or terminate your account for violations of these Terms or other legitimate business reasons.

If your account with us is terminated, your right to use the C1 Fitness App ceases immediately. We will also delete your account data in accordance with our data retention policies. This action is irreversible.

WARRANTIES AND DISCLAIMERS

C1 Fitness does not guarantee that the App will be error-free or that data measurements are completely accurate. Results are approximate and for personal reference only.

The App may not work correctly with all mobile devices, operating system versions, or in all environments. We are not responsible for any interruptions, data loss, or malfunctions caused by external factors such as hardware or software compatibility issues.

C1 FITNESS APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM WARRANTIES REGARDING FITNESS RESULTS, HEALTH OUTCOMES, OR MEDICAL EFFECTIVENESS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO INJURY, LOST PROFITS, OR DATA LOSS.

HEALTH AND FITNESS DISCLAIMERS

Not Medical Advice: The App provides fitness and wellness workout series for educational purposes only. Content is not intended as medical advice, diagnosis, or treatment.

Consult Healthcare Providers: Always consult with healthcare professionals before starting any fitness program, especially if you have medical conditions.

Assumption of Risk: You acknowledge that physical exercise involves inherent risks. You participate in fitness activities at your own risk.

No Health Guarantees: We make no guarantees about fitness results, weight loss, or health improvements from using the App.

ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL REGARDING ANY HEALTH CONCERNS.

GOVERNING LAW & DISPUTE RESOLUTION

The laws of Dubai International Financial Centre (DIFC) govern these Terms, without regard to conflict of law principles. In the event of any dispute or complaint, the DIFC Courts shall have exclusive jurisdiction to hear any dispute arising out of or in connection with these Terms, save for as may be required by applicable consumer protection laws.

You waive the right to participate in class action lawsuits against us.

GENERAL PROVISIONS

These Terms constitute the entire agreement between you and us regarding the App. We may assign these Terms without notice. You may not assign your rights under these Terms. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use after changes constitutes acceptance of any updated Terms.
